A cornerstone of economic theory is that rational agents are self-interested, yet a decade of research in experimental economics has shown that economic decisions are frequently driven by concerns for fairness, equity, and reciprocity. One aspect of other-regarding behavior that has garnered attention is noblesse oblige, a social norm that obligates those of higher status to be generous in their dealings with those of lower status. The results of a cross-cultural study are reported in which marked noblesse oblige was observed (...) on a reciprocal-contract decision-making task. Participants from seven countries that vary along hierarchical and individualist/collectivist social dimensions were more tolerant of non-reciprocation when they adopted a high-ranking perspective compared with a low-ranking perspective. Liver transplantation (LT) activities during the COVID-19 pandemic have been curtailed in many countries. The impact of various policies restricting LT on outcomes of potential LT candidates is unclear. We studied all patients on the nationwide LT waitlists in Hong Kong and Singapore between January 2016 and May 2020. We used continuous time Markov chains to model the effects of different scenarios and varying durations of disruption on LT candidates.

The debate over Hypothetical Syllogism is locked in stalemate. Although putative natural language counterexamples to Hypothetical Syllogism abound, many philosophers defend Hypothetical Syllogism, arguing that the alleged counterexamples involve an illicit shift in context. The proper lesson to draw from the putative counterexamples, they argue, is that natural language conditionals are context-sensitive conditionals which obey Hypothetical Syllogism. In order to make progress on the issue, I consider and improve upon Morreau’s proof of the invalidity of Hypothetical Syllogism. The improved proof (...) relies upon the semantic claim that conditionals with antecedents irrelevant to the obtaining of an already true consequent are themselves true. Moreover, this semantic insight allows us to provide compelling counterexamples to Hypothetical Syllogism that are resistant to the usual contextualist response. (shrink)

In an unpublished paper of 1693 John Locke weighed in on the ongoing debate in the English Parliament by declaring that there should be a “general naturalization” of all immigrants currently residing in England. His argument for this controversial policy was entirely economic and based on promoting England's interest in achieving greater wealth. He wrote nothing about the interests of the immigrants (most of whom were escaping religious persecution) nor did he appeal to the moral and political theory he had (...) so strongly proposed in Second Treatise of Government, published only a few years earlier in 1690. In this paper I look closely at the concepts of community and law in the state of nature and conclude that if Locke had employed the fundamental principles developed in Second Treatise he would have endorsed a far more radical policy that would have permitted the immigration and eventual naturalization of persons on humanitarian grounds. The application of these principles have important consequences for contemporary debates in the United States Congress and in other wealthy countries about the extent of the obligation to provide relief to foreigners who are escaping religious persecution, war, enslavement, hunger, and natural disaster. Locke's admittedly 'very strange' sounding doctrine of natural executive power, according to which the individual has the right to execute the law of nature, has long been one of the most controversial features of his moral philosophy. In contrast to the many commentators who deny its theoretical innovation and challenge its individualist premises, this study proposes that the philosophical significance of Locke's natural right to punish derives from its critical departure from earlier moral and political theory. As the product of liberalism's first encounter with the theoretical problems posed by legal discrimination and unequal treatment of minority groups, Locke's argument for religious toleration foreshadowed contemporary democratic theory's emphasis on non-coercive discussion of diverse rights claims and broadly inclusive public deliberations. This study tries to illuminate the democratic dimension of Locke's toleration theory by focusing on his crucial account of the church as a voluntary association. Philosophers have often claimed that general ideas or representations have their origin in abstraction, but it remains unclear exactly what abstraction as a psychological process consists in. We argue that the Lockean aspiration of using abstraction to explain the origins of all general representations cannot work and that at least some general representations have to be innate. We then offer an explicit framework for understanding abstraction, one that treats abstraction as a computational process that operates over an innate quality space (...) of fine-grained general representations. We argue that this framework has important philosophical implications for the nativism-empiricism dispute, for questions about the acquisition of unstructured representations, and for questions about the relation between human and animal minds. The object of this article is to clarify the relationship between morality and family law in a variety of legal situations. This will give the reader a better grasp of the kind of case to be included in the traditionalist claim that the idea of legal intervention in the family is a coherent notion. Once this is sorted, we will be in a position to discuss and clarify the radical thesis that "the personal is political.".

In 1976, John Immerwahr published a classroom simulation designed to illustrate Hobbes’ model of the mutual transfer of rights in the formation of the social contract. The game is fruitfully seized upon in classrooms from a broad range of disciplines (economics, psychology, sociology, etc.) because the lesson of Hobbes’ state of nature and Immerwahr’s game can both be represented and elucidated by principles of game theory. This paper reintroduces a new generation of teachers to what the author calls “one of (...) the finest philosophy simulations ever designed”, offers suggestions on conducting the game and on how Immerwahr’s implementation of it can be improved, and discusses its game-theoretic implications. Whereas Immerwahr’s version of the game approximates the Prisoner’s Dilemma, the version presented in this paper more closely resembles the “Assurance Game”. Accordingly, the results of the author’s game indicate that, if given the chance to cooperate, students do so, and the average student finishes the game better off than in the Prisoner’s Dilemma. The author relates the results of his game to the theories of Hobbes, Locke, and Rousseau, and concludes by underscoring the richness of the game for philosophical analysis. (shrink)

This essay critically analyzes two dominant narratives that explain and lament the rise of Donald Trump in the United States. First, I extend Jill Locke’s (2016) concept of “The Lament that Shame is Dead" to show the limitations of criticizing Trump in terms of the “death of shame.” I then turn my attention to the problems inerent in recent characterizations of Trump as a petulant child. Drawing from Locke (2016) on shame and Freud (1914) and Lee Edelman (2004) on the (...) politics of “the child,” I argue that characterizing Trump as shameless, childish, or as a shameless child only affirms, rather than deposes, Trump’s right-wing populist strategy and keeps the focus on him as a personality rather than on the broader social and political context in which he emerged. At least since Martin Heidegger’s influential reading of Thomas Aquinas’s account of truth as a precursor to modern philosophy’s unfortunate “forgetfulness of being,” it has been popular to classify the Angelic Doctor as one of the fore­runners of the modern “correspondence theory” of truth. In what follows, I attempt to answer the question of whether or not this is a correct assessment. I want to suggest that Aquinas’s account of truth has superficial concord but deep conflict with modern correspondence theories. (...) The argument proceeds in two major segments: First, I attempt to establish a working definition of correspondence theory by tracing its development in the work of John Locke, John Stuart Mill and Bertrand Russell. Popular sovereignty - the doctrine that the public powers of state originate in a concessive grant of power from 'the people' - is perhaps the cardinal doctrine of modern constitutional theory, placing full constitutional authority in the people at large, rather than in the hands of judges, kings, or a political elite. Although its classic formulation is to be found in the major theoretical treatments of the modern state, such as in the treatises of Hobbes, Locke, and Rousseau, this book (...) explores the intellectual origins of this doctrine and investigates its chief source in late medieval and early modern thought. Long regarded the principal source for modern legal reasoning, Roman law had a profound impact on the major architects of popular sovereignty such as François Hotman, Jean Bodin, and Hugo Grotius. Adopting the juridical language of obligations, property, and personality as well as the model of the Roman constitution, these jurists crafted a uniform theory that located the right of sovereignty in the people at large as the legal owners of state authority. In recovering the origins of popular sovereignty, the book demonstrates the importance of the Roman law as a chief source of modern constitutional thought. (shrink)

This article examines John Locke’s theory of subjectivity to challenge the recent critical tendency to associate biopolitics and empiricism. Michel Foucault, most notably among modern theorists of biopolitics, proposes that the Lockean man, or an interest-seeking animal, constitutes the paradigm of a person that remains subject to biopower. Such understanding of empiricism by biopolitical theorists is, however, reductive because Locke’s view of human subjectivity is fundamentally equivocal. As I demonstrate by analyzing his discussion of freedom, action, and desire in An (...) Essay Concerning Human Understanding and other writings, Locke admits the possibility for a human being to think and to act freely, although in the process of restricting the capacity for free action. Hence, the theorists’ simplistic view of Locke rather reflects the limits of their own conception of subjectivity, especially their behavioristic premises. As they consider a person as a mere machine of survival without agency and initiative, they preclude the possibility of overcoming biopower at the fundamental level. In demonstrating contradictions and tensions within Locke’s empiricism, this article then proposes the ways in which Locke can show a way beyond the critical impasse in political theory in elucidating the power of acting against the chain of causality. This article investigates the potential of fMRI to test assumptions about different components in models of complex cognitive tasks. If the components of a model can be associated with specific brain regions, one can make predictions for the temporal course of the BOLD response in these regions. An event‐locked procedure is described for dealing with temporal variability and bringing model runs and individual data trials into alignment. Statistical methods for testing the model are described that deal with the scan‐to‐scan correlations (...) in the errors of measurement of the BOLD signal. This approach is illustrated using a “sacrificial” ACT‐R model that involves mapping 6 modules onto 6 brain regions in an experiment from Ravizza, Anderson, and Carter (in press) concerned with equation solving. The model's visual encoding predicted the BOLD response in the fusiform gyrus, its controlled retrieval predicted the BOLD response in the lateral inferior prefrontal cortex, and its subgoal setting predicted the BOLD response in the anterior cingulate cortex. On the other hand, its motor programming failed to predict anticipatory activation in the motor cortex, its representational changes failed to predicted the pattern of activity in the posterior parietal cortex, and its procedural component failed to predict an initial spike in caudate. The results illustrate the power of such data to direct the development of a theory of complex problem solving, both at the level of a specific task model as well as at the level of the cognitive architecture. This chapter aims to articulate the motivation behind an insurrectionist philosophy. On this account, insurrectionist philosophy is about rejecting a world (and its norms and intervening background assumptions) and creating the possibility for transvaluation or a radical revolution of values. McBride III -/- American Pragmatism: An Introduction is a judicious and stimulating read, comprising an introduction and five numbered chapters. The introduction orients the book, offering various ways of conceiving American Philosophy and American pragmatism. Spencer explains that it is difficult to discern the national and cultural variables that make a philosophy an (...) American philosophy. Not all philosophers who practice philosophy in the United States claim the descriptor "American Philosophy." And, within the group that embraces the descriptor, some take American pragmatism to be, in essence, a theory of truth (or a method by which we can make our ideas clear); others take pragmatism to be a method of experience, a pluralistic approach to knowledge creation and social amelioration (2). It is a complicated picture, and Spencer affords ample care and attention to the disparate camps of pragmatism. Chapter 1: "Fallibilism and the Classical Pragmatists" is largely devoted to Charles S. Peirce and William James. Peirce and James, as fallibilists, are contrasted against Descartes and Hume, respectively. Peirce and James diverge in regard to style and their commitments to (scholastic) realism. Spencer discusses Josiah Royce briefly at the closing of the chapter, noting how Royce's work can serve as a foil for both Peircean and Jamesian pragmatisms. Chapter 2: "Meliorism and the Chicago Pragmatists" highlights the pragmatist philosophical contributions of Jane Addams and John Dewey. In this chapter, Spencer emphasizes sympathetic knowledge, cooperative intelligence, the pattern of experimental inquiry, and social amelioration. Spencer deserves kudos for introducing Addams's pragmatist contributions first, then explaining the ways in which her work in community-building and social amelioration influenced Dewey. Chapter 3: "Pluralism and the Harvard Pragmatists" highlights the work of a motley crew: George Santayana, W. E. B. Du Bois, Horace Kallen, and Alain Locke. This chapter draws attention to the pluralism one can detect in Santayana's detached cosmopolitanism, Du Bois's double consciousness, Kallen's cultural pluralism, and Locke's democratic pluralism. We are introduced to a Spaniard, two African American men, and a Jewish man, all of whom had spent time abroad. Each offers a critical perspective that falls outside the conventional view of the purported democratic culture of the United States. Chapter 4: "Verification and the Analytic Pragmatists" turns to the philosophers of the logico-linguistic turn, [End Page 108] featuring C. I. Lewis, W. V. O. Quine, and Richard Rorty. Here, we see a pronouncedly analytic approach to the analysis of propositions, inference, and semantic content—a heightened attention to shoring up defensible conceptions of truth and the real. The goal is to articulate a coherent conceptual pragmatic position that evades both scientistic reductionism and Fregean transcendental presuppositions, all the while offering a feasible conception of truth. Chapter 5: "Hope and the Contemporary Pragmatists" surveys how pragmatists have engaged with various traditions in the twentieth and twenty-first centuries to potentially bolster their positions and find hope. Spencer highlights three promising strands. The first strand is that of Jürgen Habermas. Habermas arose out of Frankfurt School critical theory but appropriated pragmatist insights from Peirce, Dewey, and Mead to formulate his conceptions of communicative action and communitive rationality (208). Habermas reconstructed the reductive dialectical materialism of the Frankfurt School, developing a sophisticated theory of democracy as public discourse. Spencer asserts that "ultimately Habermas is the best demonstration of pragmatism's potential when compared with critical theory during the Cold War" (208). Spencer also finds the work of Huw Price promising. Price, in an effort to defuse the tension between neopragmatism's antirealism and scientific realism, offers a tenable theory of truth: truth as a (postulated) practical norm, or "truth as a convenient fiction" (217). Truth, as a practical norm, gives normative structure and impetus to various forms of inquiry. And, to close this chapter on hope and contemporary pragmatism, Spencer delineates a third promising strand. He writes that "perhaps the most promising development among pragmatists results from their increasing engagement with American Indian philosophy and other philosophical traditions throughout the Americas" (219). This chapter draws questions of race into food ethics. Appropriating a conception of race articulated by Alain Locke (1885‒1954), it is suggested that racial imperialism and the attending drive to claim proprietary ownership of racialized cultural products is responsible for much of the intercultural strife and race-based injustice in the modern world. Foods and foodways, understood as cultural products, are then discussed against the backdrop of racial partisanship in the exchange and consumption of foods and cuisine. Notions of authenticity and (...) cultural appropriation are discussed in this light. It is argued that there is a place for race in the discussion of food ethics and that racial imperialism and racial partisanship in the exchange and consumption of foods should be repudiated. Although Henry Lee is often recognized to be an important early critic of Locke's 'way of ideas', his Anti-Scepticism (1702) has hardly received the scholarly attention it deserves. This paper seeks to fill that lacuna. It argues that Lee's criticism of Locke's alleged representationalism was original, and that it was quite different from the more familiar kind of criticism that was launched against Locke's theory of ideas by such thinkers as John Sergeant and Thomas Reid. Is a human more conscious than an octopus? In the science of consciousness, it’s oftentimes assumed that some creatures (or mental states) are more conscious than others. But in recent years, a number of philosophers have argued that the notion of degrees of consciousness is conceptually confused. This paper (1) argues that the most prominent objections to degrees of consciousness are unsustainable, (2) examines the semantics of ‘more conscious than’ expressions, (3) develops an analysis of what it is for a (...) degreed property to count as degrees of consciousness, and (4) applies the analysis to various theories of consciousness. I argue that whether consciousness comes in degrees ultimately depends on which theory of consciousness turns out to be correct. But I also argue that most theories of consciousness entail that consciousness comes in degrees. (shrink)

The goal of this paper is to critically examine the objections of John Locke’s contemporaries against the theory of substance or substratum. Locke argues in Essay that substratum is the bearer of the properties of a particular substance. Locke also claims that we have no knowledge of substratum. But Locke’s claim about our ignorance as to what substratum is, is contentious. That is, if we don’t know what substratum is, then what is the point of proposing it as a bearer (...) of properties? This question underlies the criticism Locke’s contemporaries raise against the notion of substratum. In section I, I lay out the context for Locke’s theory of substratum by pointing out his main motivation in proposing his theory. In section II, I give a brief analysis of the theory of substratum. In section III, I discuss the objections of Locke’s contemporaries against the theory of substratum.1 I focus on Edward Stillingfleet, Lee Henry, G. W. Leibniz and John Sergeant. In section IV, I conclude that there is no warrant to dismiss Locke’s theory of substance. (shrink)

This paper examines the idea of "objective phenomenology," or a way of understanding the phenomenal character of conscious experiences that doesn’t require one to have had the kinds of experiences under consideration. My central thesis is that structural facts about experience—facts that characterize purely how conscious experiences are structured—are objective phenomenal facts. I begin by precisifying the idea of objective phenomenology and diagnosing what makes any given phenomenal fact subjective. Then I defend the view that structural facts about experience are (...) objective. Cloth, $75.00.Professor Sell’s goal is to discern the impact of Locke’s thought upon the later divines; Sell’s scope is the seventeenth century through the nineteenth century. Most of the text is a detailed descriptive account of various scholars’ reactions (...) to Locke’s epistemology, metaphysics, and views concerning religion. Sell focuses on the question of the relative authority of scripture, reason and revelation. He contends that Locke’s epistemological and political positions are intimately bound up with his Christian faith, that as a conservative empiricist, Locke is “much more the rationalist than he has sometimes been painted” (48). The important question bequeathed by Locke to Christian apologetics is: “can the epistemological starting point be redeemed for Christian apologetic use or is it not viable at all?” (12). Sell addresses this question throughout the following chapters: “Ideas, Knowledge and Truth”; “Reason, Revelation, Faith and Scripture”; “Morality and Liberty”; “Toleration and Government”; and “Christian Doctrine”.Sell notes Locke’s roots in Calvinism, his appreciation of Arminian doctrine and his friendship with a number of prominent Latitudinarians. He argues that most criticisms of Locke’s Reasonableness of Christianity are misguided. During the seventeenth and eighteenth centuries Locke was charged with scepticism, deism, Socinianism and materialism. Sell presents the objections of numerous scholars, notably Bishop Stillingfleet, William Carroll, John Norris, Richard Bentley, Henry Lee, Richard Price, Bishop Berkeley, and Samuel Johnson. He also covers the views of Locke’s defenders, including Anthony Collins, Catharine Cockburn and Samuel Bold.The reader might be disappointed with Sell’s short presentation of an inordinate number of Lockean critics; there is little analysis or discussion of the merits of the particular objections cited. He does offer an analysis of the general charges against Locke, but rarely quotes Locke sufficiently to justify his conclusion that Locke was not a deist, sceptic, or materialist. Sell simply takes Locke’s word for it. This book is best taken as an excellent reference guide.Sell contends that in spite of Locke’s friendship with deists such as Collins, Locke’s Reasonableness of the Christian Religion was written to dissolve the deist prejudice against Christianity. He dismisses the charge of deism because: (1) Locke argues for revelation and against natural religion, (2) Locke’s God possesses the traditional attributes assigned to him (power, omniscience, providence), (3) Locke grounds morality not exclusively in natural law, as did deists, but in the gospel, (4) the anti-materialist thrust of Book IV, Chapter X of the Essay, and (5) Locke’s argument that there can be truths of revelation which are above reason. Sell concludes that the “main problem posed to Locke by the deists was that of guilt by association” (209), in other words Locke’s work was misused for political reasons.Sell considers the charge of Socinianism more serious than that of deism. Socinianism is defined by its denial of the Trinity, and by the claims that there cannot be an innate idea of God, that there is no original corruption deriving from Adam, that the wicked will not suffer eternal torments, and that some bodies are not raised at general resurrection. Despite Locke’s agreement with most Socinian claims, Sell claims that [End Page 631] Locke cannot be pinned down on the issue of the Trinity. There is no question, he says, that “the Locke of 1662 affirmed both the doctrine of the Trinity and the human divine nature of Christ, whilst recognizing that the human mind could not explain how these things could be so; there is no question that especially from the 1690’s onwards he was actively reviewing the matter; there is no hard evidence that he ever repudiated the doctrine.” (214)According to Stillingfleet, Locke’s sensationalism and his proposal that matter might be capable of thought undermine Christian faith. Background Nurses providing care to patients with end-of-life or terminal illnesses often encounter ethically challenging situations leading to moral distress. However, existing quantitative studies have examined moral distress using instruments that address general clinical situations rather than those specific to end-of-life care. Furthermore, qualitative studies have often been limited to participants from a single unit or those experiencing moral distress-induced circumstances. A comprehensive and integrated understanding of the overarching process of moral distress is vital to discern the unique circumstances surrounding (...) end-of-life care and its consequential impacts. Research objectives To explore the moral distress experiences of nurses who are frequently involved in caring for patients with end-of-life or terminal illnesses and apply it to two existing theories: the model of moral distress and the ecological model. Research design A qualitative descriptive approach was employed. Participants and research context Seven focus group interviews involving 30 nurses were performed. The subsequent transcriptions underwent rigorous content analysis. Ethical considerations We obtained Institutional Review Board approval from a university. Focus group interviews were conducted with nurses who agreed to participate and signed the consent form. Findings The moral distress-inducing factors and nurses’ perceived impact of moral distress were identified and categorized based on moral distress theories and ecological models. A total of 15 categories and 30 subcategories across the following 4 domains were derived: (1) intrapersonal, (2) interpersonal, (3) organizational, and (4) structural factors. Conclusions End-of-life-specific circumstances induced moral distress among nurses, with both negative and positive impacts identified. Effective organizational and policy support is essential to manage conflicts, form a healthy organizational culture, provide training, and prevent unnecessary expenses due to the negative consequences of moral distress. Algorithms increasingly make managerial decisions that people used to make. Perceptions of algorithms, regardless of the algorithms' actual performance, can significantly influence their adoption, yet we do not fully understand how people perceive decisions made by algorithms as compared with decisions made by humans. To explore perceptions of algorithmic management, we conducted an online experiment using four managerial decisions that required either mechanical or human skills. We manipulated the decision-maker, and measured perceived fairness, trust, and emotional response. With the mechanical (...) tasks, algorithmic and human-made decisions were perceived as equally fair and trustworthy and evoked similar emotions; however, human managers' fairness and trustworthiness were attributed to the manager's authority, whereas algorithms' fairness and trustworthiness were attributed to their perceived efficiency and objectivity. Human decisions evoked some positive emotion due to the possibility of social recognition, whereas algorithmic decisions generated a more mixed response – algorithms were seen as helpful tools but also possible tracking mechanisms. With the human tasks, algorithmic decisions were perceived as less fair and trustworthy and evoked more negative emotion than human decisions. Algorithms' perceived lack of intuition and subjective judgment capabilities contributed to the lower fairness and trustworthiness judgments. Positive emotion from human decisions was attributed to social recognition, while negative emotion from algorithmic decisions was attributed to the dehumanizing experience of being evaluated by machines. This work reveals people's lay concepts of algorithmic versus human decisions in a management context and suggests that task characteristics matter in understanding people's experiences with algorithmic technologies.
